These Terms & Conditions (“Terms”) govern your use of the Site and any services obtained through it. 1. Applicability of These Terms

5. Business Services; No Retail Lending

5.1 As a specialist B2B finance provider, EVG Finance offers working capital solutions, supplier financing, gap funding, and related credit products exclusively to commercial borrowers. You represent and warrant that any application, inquiry, or submission of information through the Site is made on behalf of a bona fide business or entity, not in an individual or retail capacity.
5.2 All quotes, term sheets, and loan agreements available via the Site are intended solely for business purposes. EVG Finance is not obligated to accept any application and reserves full discretion to approve or decline lending requests in accordance with our credit policies and regulatory requirements.

6. Disclaimers and Limitation of Liability

6.1 “AS IS” Basis. EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE SITE AND SITE CONTENT ARE MADE AVAILABLE ON AN “AS IS” AND “AS AVAILABLE” BASIS. EVG FINANCE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE SITE OR OUR SERVICES.

6.5 Limitation of Liability. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE EVG PARTIES TO YOU EXCEED £1,000 (ONE THOUSAND POUNDS STERLING) OR THE AMOUNT YOU PAID TO EVG FINANCE IN THE SIX (6) MONTHS PRIOR TO THE ACT GIVING RISE TO LIABILITY, WHICHEVER IS LOWER. THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER THEORY OF LIABILITY.
6.6 Nothing in these Terms is intended to exclude or limit liability for (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.

14.1 These Terms, together with any documents or policies expressly incorporated by reference (including our Privacy Policy), constitute the entire agreement between you and EVG Finance regarding your use of the Site and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to the same subject matter.
14.2 Any terms and conditions in a Client’s purchase order, request for proposal, or similar document will have no effect, even if they are signed by EVG Finance or its representatives, unless EVG Finance expressly agrees to such terms in a separate, signed writing.
